Victor DeLorenzo may be "In Dutch" with the widow of Buddy Holly. Maria Elena Holly said she questions the legality of Milwaukee rock musician DeLorenzo writing music for one of the late singer's unpublished songs. She also said she doubts the lyrics' authenticity. DeLorenzo has titled the song "In Dutch." DeLorenzo, a former member of the Violent Femmes, wrote music for the untitled lyrics, which were written on a piece of note paper. That piece of paper was sold to Howard Thompson, a New York record company executive, at a Sotheby's auction of Holly memorabilia in 1990. The former Violent Femmes drummer ran across the lyrics while visiting Thompson's apartment. DeLorenzo performed "In Dutch" Friday night in Green Bay, and will perform it again at a series of Buddy Holly tribute shows in Wisconsin this month. DeLorenzo has also recorded the song but says he has no plans to release the recording. The mostly middle-aged Green Bay crowd gave the song a round of receptive applause Friday night. Holly, whose hits included "That'll Be the Day," "Oh, Boy" and "Peggy Sue," died in a plane crash 41 years ago Wednesday. He and Maria Elena had been married less than six months. Maria Elena Holly says she does not remember a song like the one DeLorenzo now calls "In Dutch." But, according to Connie Gibbons, director of the Buddy Holly Center in Lubbock, Texas, a 1990 Sotheby's Holly auction catalog does describe one item as a song with lyrics that match those of "In Dutch." Maria Elena Holly also says that all of Buddy Holly's unpublished songs are copyrighted. No one can use that material without securing permission from her or one of Holly's two publishing companies, she said. "Whatever they want to do, they have to come to me, Paul McCartney's (company) MPL or Southern Music," she said. "They're Buddy's songs; they're nobody else's songs . . . He (DeLorenzo) has no authorization to do that. Who gave him permission to do that?" "I'm not opposed to anything that is done properly. I'm not opposed to things that are authentic. I'm not opposed to things that will enhance Buddy Holly's name. Mr. DeLorenzo took it upon himself to do this, and I think he's wrong. I want to make sure somebody is not deceiving the fans. My concern is with the fans." In general, the copyright - or the exclusive right to publish, produce or sell an artistic work - belongs to the person who created it in the first place. Copyright law is really a bundle of rights. These rights are designed to protect the artist and convey control over the circumstances under which a work of art may be reproduced. This includes performance rights, and, in the case of "In Dutch," derivative works. The copyright lasts for the life of the artist, plus 70 years, then falls into the public domain. But artists or their heirs often sell these rights, and the rights to an artist's works may change hands. One factor that might complicate this case is that copyright law has changed since Holly's lifetime, said Dan Jones, an attorney with the Milwaukee law firm Michael Best & Friedrich LLP. Under the old copyright law, it was easier for works to fall into the public domain. Jones explains three factors under the old law: Was the work published? How many copies were made? And was there a copyright notice on it? The new copyright law, which took effect in 1978, takes a more expansive view of artists' rights and makes it more difficult for a work of art to fall into the public domain, where anyone may reproduce it without having to compensate the original author. Although DeLorenzo said Thursday that he would probably eventually contact Maria Elena Holly, he didn't want to argue legalities. "I really don't have anything to say. This was an act of love. I didn't do it for money. I have no plans to release the record. If I wanted to make money, I would have released this years ago. It was my celebration of the spirit and music of Buddy Holly," DeLorenzo said. "I'm kind of just leaving it in her camp." A friend of mine bought it for me in Paris. It's a terrific album, Gordon did a very good job. The album is a little bit heavier than their first one. One of the songs from the album "La ballade de basse", sound a little bit like "Color me once". It is available in Canada by Musicor distribution. We're adults; I don't listen to very much rock music anymore. I listen to classical and other age-appropriate music like jazz. >> Like Monica, I also am disturbed by Brian Ritchie's comments that Rock N Roll is for young people only. I guess that I am confused because I am Brian's age and I think that I am still young. I am as big a femmes fan as anyone and their music still speaks to me. My life is filled with family and business responsibilities but to unwind I usually end up playing the femmes. Loud !!! I enjoy all types of music but one. I can't relate to jazz.
